Hi okay so my younger brother, Dylan, has been getting harassed by this school personnel since he was in the 4th grade. My brother in 2nd grade was Dx w/ Legg Calves Perthes disease, it is a very pain full cond. where the ball of his femur loses blood supply and deteriorates. This man has called my parent and questioned them about my brothers cond. My parent thought he was a councilor, and began to tell answer his questions which became increasingly private. We later learned that this man is just a secretary, for the assistant principle, how he got the med. record of my brother amazes me.
That's just the beginning. My mother approached the assistant principle and she said sorry and that she'd talk to the guy. He did about 3 other things, which included him going to my 3 other brothers and questioning them about where my other brother was (he was home often because his bone was growing back its very painful), my brother also was suspended thats year and the guy went to the eldest of my brothers during lunch and said in front of them all that my brother was suspended, once again we went back to the school. this time to the guy himself and both the principle and assistant principle.
5th grade started and he got once of the worst possible teachers in the world. this woman is awful (this is coming from having her as a substitute teacher in third grade for one day I could never imagine having to go to her class every day for 180 days) she calls the kids names and tell them that they will never amount to anything. Anyways that guy would talk to ms. king in front of my brother and his friends saying that my brother uses his hip as an excuse. On dec 1st he was hospitalized in the phsyc. ward for school avoidance. the poor kid was terrified of going to school because of this guy and teacher. he was hospitalized till jan 13th. when he got out he had to get back into school slowly and this teacher would taunt him and everything trying to get him to act out and have an episode. well on one occasion occasion my brother was sent down to the the office and none other then the guy was there. my brother asked to speak with our father and the guy ignored him...several times. then the guy got up and lock the door with him and my brother in it. my brother asked again and same thing happened. he was ignored. two more times. then my brother had another episode and he got suspended because he threw a desk. but if you were 12 and in his situation what would you do? the guy has also called my brother names and said derogatory things to him like "look at yourself in the mirror first". my parents once again went there and actually yelled at the guy and the principles, and tried to get Dylan moved to a different school we got denied and then denied to have him moved to a different class.
this year starts and we find out the guy was not there this year, can some one say praise God? 6 weeks later my brother Clayton comes home and says the guy is back. Dylan had stayed home that day because he was sick with the flu and due to return to school the next day. he had gotten his grades up to a's and b's. but once he returned to school the guy stares at my brother and deliberately taunts him. dylans grades quickly dropped and he would get dismissed at lunch time where the guy monitors the cafeteria and provokes my brother the most. my brothers anger outbursts also started reacurring. he asked to get help and got readmitted at the hospital the week after thanksgiving and released last friday.
sorry i forgot to mention that the superintendant did not help at all, we went to him about 9 times.
what can we do? could we get a restraining order? if so what kind?
and what kind of lawyer(should we take legal action)?
