My bike is broken. Can I take it back?

My boyfriend brought a 125cc moped back in August. When it was delivered it was fine but then a couple of weeks ago it just stopped working. Turned out the battery was flat. The place we got it from wouldn't pay to have the bike taken to our local garage as we couldn't get it there so we had to pay for the labour, pick up charge and part. Obviously it is under warranty (until end of November) so we are asking for the money for the battery.
Also, when the bike was at the garage we noticed that the nut was missing from the brake meaning that the brake cable was dangerously close to coming loose! Something they obviously didn't pick up on when they serviced it before selling it to us!
Today the bike stopped working again. The engine runs and there is power but it just doesn't have enough power to go when someone is sitting on it.
Have just sent a letter saying that we are rejecting the bike as it is faulty and that we want a full refund.
Any other suggestions? Are we doing the right thing? Comments appreciated!
