In our contract the vendor said that the boiler was broken but that he was going to replace it. Instead he told us he had had it fixed - a 'report' from a plumber was sent to our solicitor. We verbally agreed that as long as it was fixed and wouldn't break a month after we'd moved in then it should be ok. 2 DAYS after we moved in the boiler completley fell apart - my partner has since found out that the 'plumber' who provided the certificate was a good friend of the vendors - we think he lied about fixing it as every plumber we have had come round has said that it hasn't been serviced in at least 2 years. I thought that this would be a breach of contract as in writting it says he would replace the boiler - however apparently we do not have a leg to stand on now we have moved in????
