Military BAH question?

If I am on a lease with my child's mother can I still get BAH? I dont pay child support and my name is on the birth certificate. Is my child still considered a dependent under military law??
 
Yes as long as you are the father, legitimite or otherwise and can prove it to admin, you should receive dependant BAH and must pay it to the child's mother or guardian. If you qualify for BAH in any other way then you only need to meet your obligations.
 
not necessarily. No court order for Child support, you may have a hard time getting authorization to get BAH at either the single or W/Dep. rate.

just living off base base does NOT necessarily mean you are authorized to receive BAH ESPECIALLY if you are Single and Below E5.

of course if you a re just now trying to enlist: you are DQd as you are considered a single parent. ESPECIALLY of you live with the kid and you are not married. In this scenario you would need to provide court papers showing you had NO custody whatsoever and did not reside with the child at all...and a separate order would be needed for child support.
