I just bought a 2007 Mazda CX7 from a certified mazda dealer in NC. I drove it home to TN. it has 34,000 miles on it. I have had the oild changed appropriately. However, last week the engine completely failed. The car was towed to a nearby mazda dealer. I was first told that the car was under warranty. then they called me the next day and said repair would not be covered under warranty...saying that it was caused by a "lack of maintanence". The cost exceeds $8,000. I did buy the car used. They told me that if i could give them proof of maintanence, it would be covered. I did just that. and they still are saying that they would not cover it. I also had the mazda dealer that i bought the car from, fax their records. the car turbo was replace under warranty at the dealer about 3 months before we bought it. How can i get them to cover this? I am thinking of hiring an attorney because the dealer was to "certifiy" the vehicle. the mechanic said that there was sludge build up in the car that definately was there before we bought it. How do you think our case would hod up if we went to court against Montgomery Mazda? please help. it definately was not a lack of maintainence on our part, when we bought the car, they said that the car had been maintained appropriately, yet there is a large gap from 6000 mile oil change to the next at 14,000 miles. when we first requested the record of oil changes from the previous owner, mazda said they had them but could not disclose that information due to customer privacy.
