Lore behind souls and soul gems in the elder scrolls series?

I find it odd that the game literally has you collecting souls just to create and/or recharge your enchanted items. Why did they choose to make it so you had to essentially be an evil mage to keep enchanted equipment? How do the inhabitants of the world justify doing this, and why is it that certain species require black soul gems to capture, there doesn't really appear to be a pattern. Most elves require black soul gems to be soultrapped, but the falmer in skyrim dont, and goblins in oblivion dont need black soul gems either, despite the fact that they're obviously intelligent.

To me, it appears the developers are expecting the players to play evil characters just to survive in the game, i know in oblivion enchanted weapons are a necessity to be able to take down monsters in any reasonable amount of time (i'm at lvl 26, and when my sword runs out of charge i cant even see their hit points going down anymore, even though my sword deals 24 damage even without the enchantment, which adds a total of 25 damage, 5 of which is health absorbtion)
