Ladies, if someone is caught having "sex" with another person's spouse, should they

go to jail ? Or should it not be a legal matter. I mean this can go many ways.
But what can you do. I mean you can fight it out, like most people
would do. But in reality you can be prosecuted for putting your
hands on someone through violence. But lets say that you are at
a hotel. And you are in bed with someone elses spouse. Then their partner finds out that he or she was cheating on you. Then they do
the spy thing. And follow you to that particular hotel. And then,
they just walk right in. There you are, in bed with another person's
husband or wife. Can they or should they go to jail for adultery................
 
No, I think as long as its sex between consenting adults its not a matter for the police or government.
 
Since feminists see marriage as a "contract" instead of a convenant, anybody who has sex with a married person (other than their spouse, of course) should be subject to a tortious interference lawsuit. Tortious interference occurs when one person tries to get another person to breach their contract. As long as the other person is aware that the first person is married, he could be held liable for damages incurred by divorce. That would make it a civil and not a criminal matter, however.
