Dear PIPEX Customer,

We have received a complaint regarding an allegation of "Copyright Infringement"

As I am sure you are aware, this breaches our Acceptable Use Policy, http://www.pipex.net/legal/aup/ and many copyright laws, namely the Berne Convention.

Please can you try and ensure that your account is not used for this type of alleged activity.

Notice ID:5424033
Notice Date:22 Jun 2004 18:21:16 GMT

Dear Sir or Madam:

BayTSP, Inc. ("BayTSP") swears under penalty of perjury that Paramount Pictures Corporation ("Paramount") has authorized BayTSP to act as its non-exclusive agent for copyright infringement notification. BayTSP's search of the protocol listed below has detected infringements of Paramount's copyright interests on your IP addresses as detailed in the attached report.

BayTSP has reasonable good faith belief that use of the material in the manner complained of in the attached report is not authorized by Paramount, its agents, or the law. The information provided herein is accurate to the best of our knowledge. Therefore, this letter is an official notification to effect removal of the detected infringement listed in the attached report. The Berne Convention for the Protection of Literary and Artistic Works, the Universal Copyright Convention, as well as bilateral treaties with other countries allow for protection of client's copyrighted work even beyond U.S. borders. The attached documentation specifies the exact location of the infringement.

We hereby request that you immediately remove or block access to the infringing material, as specified in the copyright laws, and insure the user refrains from using or sharing with others Paramount's materials in the future (see, 17 U.S.C.

Write a polite letter back saying you will check it out,

....and then ask if you can have a copy of the Court Order that BayTSP must have had in order to monitor your Communications under UK Law... as your quite sure they aren't one of the UK National Security organisations....

As we have never yet had a UK Solicitor come to the site to give our Rights under UK Law...I just want to know what their response will be

;)

may wanna try anonx. i use it, although it slows down the connection speed a bit, they cant see you (cuz then you are in the spirit world :P )

and on a side note, my freind got hit 3 times with letters like that, its almost like they red flag your IP, so he now signed up with anonx, and hasnt seen nothing since.

Just for information...

In the UK, ISP's only have to keep IP information for Billing Purposes...

Its therefore up to the ISP if they even keep IP info after you pay your Bill....

ie a Month or so...

It might be worth checking the policy of different ISP's on this, prior to changing ISP etc.... its just that little bit more added security, if the ISP hasnt a clue who had that IP 6 weeks ago

:D

It's a very polite letter too :D

RF I might do that, just to see the response [/b]

please do!! [/b][/quote]
True good manners cost nothing

maybe they didnt need a court order to monitor his communications. Couldnt BayTSP just logon to eDonkey, do a search, and come up with your info? I'm not familiar with eDonkey... is it possible to retrieve a user's IP address?

Say that your friend told you Pipex were spying on what people did over the internet and that you told him to zip up aload of homemade movies and send them over to you using a popular fileshare program. This proves his point and isnt this against there privacy policy or soemthing.

They can't know if they were real files or fakes unless they ahve your hard drive and there not gonna do that.
