Judge Sotomayor's Record?

Judge Sotomayor ruled this year that a State governments have the ability to deny citizens' rights guaranteed by the Constitution. (Maloney v. Cuomo) Essentially, the Federal government has to follow the Constitution, but lesser authorities do not.

This seems to violate the 14th amendment.

What do you think?
