My friend lives in an 8 unit apt building in western WI. My sister and I were visiting her this past week and at 130 in the morning he came and knocked on the door, said someone had complained that we were running up and down the stairs. We had been outside talking because my sister was smoking and we weren't talking loud, nor going up and down the stairs. They get into an argument and he said he would be back at 9 am. He was telling her that he was going to have the sheriff come over and evict her.
He comes back at 9 am and we were sleeping so we didnt answer the door. He calls my friend and when she calls him back a couple hours later he said he would be over when she got home from work at 11 pm that night. My sister and I said we weren't going to be there at 11.
I called and talked to the sergeant later that afternoon and he basically told me that the only way she could be evicted is by a judge.
The landlord shows up at 10:30 and my sister and I hid in the shower. He hands her a piece of paper and asked her to sign it saying she will not have any guests at her apt between the hours of 9 pm and 9 am. He said if she didn't sign it he would go ahead and force eviction on her. It also read that other tenants in the building were going to be notified about this and inform him of any violations and the violators will be cited for trespassing and she will be evicted. She has always paid her rent on time and he has discussed a noise issue with her once before when he gave her a 5 day compliance and there were no issues during that time.
Then he asked her if he can go ahead and look around the apt to make sure no one else was there. She said NO and he argued with her saying she must be hiding something because she's let him look around before. He did anyway, found us in the shower. I got in his face, said she did not give him permission to look around, this was against the law, he was trespassing and told my friend to call the police.
3 officers arrived and they said if she wanted to go ahead and press charges for trespassing then he would send it to the DA and see if she will. They had her sign the agreement in front of them and then I asked the officer if he could evict her for her refusal to sign this agreement. The officer said "he can do whatever he wants, he's the landlord." Basically contradicting everything the Sgt told me earlier that day.
So she don't know what to do now.We stayed there through the weekend and didn't have any problems but still, we don't think this is right.
The only things listed in the lease are no smoking inside, no pets, and no storage outside.
