So I got arrested for possession of a controlled substance. Yes, I take full responsibility as I was in possession of illegal substances. However, I feel there was no reason for them to come up to me in the first place which I may use as a legal defense, I am just wondering if there is actually a basis for this. Please only answer this if you have legal knowledge, not if you are guessing. Here is the situation....My friend and I had bought drugs in the parking lot of burger king. After, we went inside and got food then returned to my car. We sat in the parking lot with other cars just talking for a couple minutes. We saw a cop car pull in the parking lot and drive to the exit. As they were about to turn out, they instead backed all the way up and drove up to my car. I had paraphernalia sitting in the pocket below the window. For NO REASON whatsoever (doing nothing suspicious, I feel like it was because we were white in a predominantly black area) the cop comes up to my car and knocks on the window. I roll my window down and he asks what we are doing and I say eating. He asks where the food is and my friend shows him the burger king bag. Then he pokes his head in my car and peers around and sees the paraphernalia and you can guess where the story goes from there. I know I am guilty of possessing drugs but how on earth did he have reasonable cause even to APPROACH my car??? I feel like it was racial profiling, because they had absolutely no reason to ever come over to my car, and they weren't there before we bought the drugs and no one saw us. The pig said it was a common place people get arrested for drugs and we were white kids in a black area. To me these are not legal reasons to have a probable cause to approach a vehicle. I know once he saw the paraphernalia he had all the reasonable cause he needed to search the car but my question is does he need a legal reason to approach the car? Because I am thinking of getting a law to represent the fact he had no legal cause to approach my car. Please only answer in you have real legal knowledge, like a lawyer or paralegal, thanks
Just fyi it wasn't marijuana
There is a difference between "a reason" and probable cause.
Thanks to the first person who answered that is pretty much what I was thinking. I think I will get a lawyer
