In the state of North Carolina that is?
A little background info: Within the decree it stated that the 401k I had was to be split 50/50. 6 years later she has still not removed her portion of that money from the 401k. Also, there is substantially less money due to the economy over the last few years, though I haven't personally removed any money.
Can I have the court compel her to remove the 50% now, or would I have to pay her what would have been 50% at the time of the divorce out of what is left? Or has she lost her rights after waiting this long?
