Is there anyway to get around att's required smartphone data plan?

i am looking to upgrade my phone to the motorala back flip which comes out march 7, but it says on their site that a data plan is required to buy the phone.. i called them up and they also said yes, you need a data plan.. i find this really unfair cuz im just a major texter and i have no need for a data plan.. thats why i have an ipod... so my question is is there anyway around it? i was thinking buying the phone with the data plan then call them up 1 day later and say i wanna cancel my data plan... what are they gonna do? take my phone away from me? if you can help me out by telling personal experiences or how u got around this BULLSHIT thing att is doing.. let me know
