justice is impossible? I was arrested by the FBI for what I believe was political reasons.
I was denied my right to appear before a judge in the district where arrested, lived, or supposed crime was committed. i.e. they went judge shopping. And did not bother having the judge appointed by the ninth circuit as would be needed for a special judge.
The judge issued a sealed court order prohibiting my lawyer from discussing my case with me. How can the lawyer represent me if he is unable to hear my side of the story?
I never waived my right to a speedy trial, but the judge kept declaring my case as complex. That way they never brought me to trial. Even beyond the one year allowed for complex findings. Nearly two years until,
I was held in solitary for over a year when another person was put in my cell, that person's wife was then put in the cell next to ours. They then interrogated her night and day until she tried to commit suicide. They then took her husband from my cell and told him to save her life that he would have to sign a statement (false) saying that I had made a jail house confession that I was planning to assassinate the president and that I was communicating the directions to do this through my lawyer. (maybe by now the judge was having second thoughts about denying my right to a lawyer and the FBI needed to prejudice him further).
After the sworn statement was signed by my cell mate (who I never spoke to), the secret service interrogated me, telling me that I had no Miranda rights because of the nature of the accusation.
That upset me so bad that I had a stroke. The jail Doctor told me that I had to plead guilty and get out or I risked being paralyzed for life.
I made a plea agreement, but Janet Reno refused to allow a No Contest plea. So I plead guilty in exchange for time served. However, before sentencing I moved to withdraw my plea, the court did not hear the motion. At sentencing, as I refused to describe any wrong doing on my part when I had entered the plea, the judge throwed out the plea agreement, did not give me the option to withdraw and gave me a longer sentence.
My lawyer then told me that as I was sentenced he no longer represented me, but that in good conscience I needed to know that I had been denied my constitutional right to a lawyer and gave me a copy of the sealed court order that prohibited him from discussing my case with me.
I appealed, the U.S. marshals confiscated my appeal when I tried to mail it. Causing me to miss the dead line of appeal by right. Remedy then can only be through filing a habeas.
Problem is under the rules the habeas has to be filed with the same judge. Who refused to hear it. That is only appealable if he issues a certificate of appeal which he refused.
I am out now and no longer in custody of any kind, except that I have this felony record. Is there anything I can do?
I did try to sue the judge for violation of my constitutional rights. But it was dismissed because of judicial immunity.
Kool Aid, maybe I'm messed up after what they did to me.
One of my co-defendants now believes he is Jesus. Another co-defendant went crazy after the FBI using velcro straps tied him to a chair for three days and nights, no bathroom, no food, with flashing strobe lights of different colors pointed at his face. Even with his eyes closed he could see it.
