"On March 4th, 2010, your local and long
distance overage minute rate will change from
$0.30 to $0.35. Get the best deal with local
or long distance minute packages from
$3/month (just 10¢/min). You’ll get more time to
talk for a lot less per minute."
I am angry with TELUS for other reasons, some being lack of service/signal, RUDE service reps, problematic phone out of warranty when purchased less than 6 months ago, and the list can continue. I have been reading about the "Material Adverse" Clauses on some websites and it states that if i do not agree with what the company is doing I can Legally cancel my contract with TELUS due to them not abiding by what I've signed. It's against the law to hold a person by a contract when it is changed by a company and the person does not agree upon it.
"Changes
These service terms (including any rates and charges) may be changed unilaterally by TELUS from time to time on at least thirty (30) days' notice to you, and such changes shall become effective once you use the service after such thirty (30) day period (which use shall be deemed conclusively to indicate acceptance of such changes)."
It states there that if I use the service for 30 days it becomes affective, but what if i want to cancel my contract due to them changing a written agreement that I do not agree on?
I currently have 150 minutes a month. IF i go over the local calling i pay an Extra $.35 a minute or If i call long distance its $.35 a minute up from $.30 PLUS long distance charges. in the contract i signed it was $.30 for each additional minute.
So if i play it right i should be able to cancel my contract due to the Material Adverse?
I know it seems petty over $.05 but after being yelled at by a CSP saying she would see my ass in court and how im a moron. I don't see a customer service rep doing that to me and all of the things mentioned above.
