Is my employer breaking the law?

I am a waitress, usually work about 7 hrs pr shift. we dont clock out for any breaks, and they give us a hard time when ever we go out for a quick smoke. the only break we really get is at the end of the night we are aloud to sit for no more then a half hour but we still have to wait on tables, and are not aloud to use our cell phone even if we go outback. there are times when we work doubles, at least a 12 hr shift. we still dont get any more breaks. are they breaking the law? how would i go about bringing it up, or reporting it?
 
i know for a fact that for every 8 hrs u work u r supposed 2 get 2 15 min breaks and and half hour lunch that u have to punch out for. anything over 8 hrs is overtime. all u have to do is contact the labor department for ur state and they will investigate and make it annyomous. sounds like you are gettin cheated but if u use ur 2 breaks and lunch, no smoke breakes so remember that
 
Not sure what state you live in. In my state you are suppose to get time for lunch (not sure of the amount) and one 15 minute break in the am and one 15 minute break in the pm. That is based off of a 40 hour work week, which would be considered full time.

Well in the Conservative world you don't have any rights as an employee, its all about your boss making money. Fortunately depending on what state you live in the Dept of Labor could better assist you.
