Is it racist if a tanning salon doesn't open in a Black neighborhood?

I ask because I live in a white part of NYC and theres a black person I know from Brownsville, Brooklyn who goes to a tanning salon in my neighborhood that complains about having to come all the way over there to go tanning as there are no tanning salons in their neighborhood. I am just wondering, could they successfully sue a tanning company for refusing to open in their neighborhoods, I mean the tanning salons could always argue that business would be minimal in a black neighborhood wouldn't they?
