is it legal to wear a bluetooth headset that covers or goes into both ears

while driving a car? there is a bluetooth headset out that plays mp3 from your phone BUT ALSO has a mic for phone conversations. I want to purchase one for myself in Ga and one for my mother in NJ. The girl at Best Buy said I should check local laws cause some states dont allow BOTH ears to be covered. I tried to search myself but had no luck. ANYONE HAVE SOME BETTER RESOURCES???
