In Texas if a self managed Board is not following the bylaws or even state laws. Example not doing annual audits, can a homeowner legally not pay dues until they are in compliance. I have asked them for any reports at several meetings including annual meeting and they have none. I am now the troublemaker in my HOA. I know it is required by TUCA law and stated in bylaws they know it too but when I ask for any I just get lied to about them. They havent done one in several years and keep promising to get one done for 6 months now. The property manager does the books and I have no legal recourse against them and I cant afford to hire an attorney myself. How can they be forced to get any done. Even the treasurer doesnt know for sure how much money we really have except when he gets a one page accounts receivable report at the end of the month. They defend the PM because he is their buddy. Cant get any legal action until I can prove money is missing and cant prove it without an audit. I was a portfolio manager for 10 years and never have I been so frustrated.
