Is it legal to hitch hike in Texas as of 2009?

Okay hitchhiking is legal so long as you obey the rules of the road. Now you have three currencies when you're hitchin: Ass, Cash, and Grass. Basically if you have sex for the ride, give them money for gas, provide some marijuana, or a combination of the three to be decided as terms for the ride.
 
My boyfriend was stopped today while hitching to work. He was on a highway...the 103 by Etoile, and was off the shoulder. The officer told him that it was against TX state law to do so, and that the next time he saw him doing it he would site him.

All of the articles I have dug up say it's okay, but the most rescent was in 2007. If anyone can point me to a site that proves it is legal, I'd really appreciate it!
