is it legal for a judge to appoint guardian without speaking to kid?

hi i am a 23 year old who due to problems i must say i caused was appointed my brother as a legal guardian plus was held as person that cant testify i never met the judge is it legal for him to appoint a guardian without personally assessing the kid or even stop me from testifying its driving me mad as i am someone who understands whats going wrong also can a legal guardian really put a kid in psychiatric ward at any whim
