Is it in violation of the HIPAA laws to disclose if someone is in or being treated

in hospital ER? I've read the HIPAA rules and am unclear if a hospital or hospital employee is in violation of HIPAA if they disclose that someone is a patient in the ER, if someone calls and asks.

I thought the hospital couldn't divulge this information to anyone without permission from the patient being seen in the ER.

Anyone?
