Is it illegal to sell refurbished electronics without disclosing it?

I purchased a Vivio LCD tv from PowersellerNYC.com and it arrived as a refurbished, defective tv. It never said anywhere on the site that it's refurbished and the tv itself doesn't clearly let you know that either. I immediately became suspicious when the manual and batteries for the remote were missing! It also came in a generic box—not a Vivio box. The tv does not work. It freezes and eventually turns off and cannot turn on.

I am going to call them tomorrow, but I see in online reviews that they have bad customer service and are very rude. I wouldn't doubt if they somehow try to screw me over.

I'm wondering if what they did was a criminal act. I mean, I've heard of people getting arrested for selling something on Ebay for example, and sending something that was not what was ordered (like a used vs new, or a lesser quality product, or a knock-off etc)

Should I just call the cops?! I'm pretty upset right now since I waited a week and a half and it looks like I'm going to have to wait a long time again. Not to mention, I paid for express shipping $125 and I DEFINITELY want that back as well!

Also, do you think Visio would be interested in learning that powersellernyc.com is selling their products as new when they're refurbished? They might help me out, no?
