Is it cheating if the relashionship isn't exactly official?

This guy I'm trying to get to know asked me out to the movies. He kissed me at the end but I didn't think he enjoyed the date because I didn't enjoy it that much. Anyway after the date the sent me an e-mail and told me how how fun he had, that he really likes me as a girlfriend and that he loves me with xoxoox and hearts o.O
Then I went on vacation and to visit family for two weeks. On his msn he wrote " (my name) ily" and on facebook he wrote "I'm so happy your back babe I miss you <3". Then I found out that he was making out with another girl who I've seen around at school while I was away. I heard it was his ex. But when I got back he asked me to be his girlfriend.
Was he cheating?
 
Can't be cheating if you aren't dating although it was pretty classless. He may have just been getting in his last chance at random makeouts before being committed. Keep an eye on him/her though. There are obviously still feelings there
