Long story short. Drunk Driver, driving without a valid license, in a company vehicle, ran into my house an three cars. My insurance took care of me, however I am out a few grand. The admitted guilt. Am I within my rights to write a letter to the company and insurance company demanding that I be compensated for my losses that were not covered by my policy? What should I be careful about?
I did speak to an attorney...said that the business is clearly at fault (negligent entrustment) because the employee had been driving without a valid license for several months. Employee also has a previous DUI with poss. of marijuana on driving record. He said it was an open and shut case.
