iphone problem with password... please help me out :(?

i bought an iphone off craigslist and its asking for the sellers itunes password. i don't have it.the seller forgot to give it to me and i cant get a hold of him... did i screw up or is this problem fixable? Please help me im so afraidd i made a big mistake. i can talk, text, and stuff i just cant download apps and stuff like that because it ask for his password. Please give me some info if you know
