In this case, should the courts go by the law or by what the victim wants?

The woman who was raped by Polanski wants the case dropped. Ok, of course she doesn't want to relive it all. Polanski was convicted of the heinous crime, shouldn't he pay for it? My opinion is of course he should pay. He should be locked up and the key thrown away. What's your opinion? Should this case be decided by the victim or the rule of law?
Special Unicorn, he was already found guilty. He fled after the fact.
Captain Parker, yes I know he was already convicted. What I mean about "reliving it all" is that it will be in the news for months until he is in an American jail. She might not want to read about it everyday in the news papers or see it constantly on the TV.
