in new mexico, is it legal to show to court with and audio recording.?

we are a mechanic shop and a lady 6 months ago we fixed her car and she left happy but while we had it we took a long time to fix it

now after the crisis i guess she came giving us a paper about us having a court with her in the paper says that we treat her bad and we never fix the car she is asking for 25.000

i once was playing around with a voice recorder and well she came here to pick her car and i continue to record and in the recording shows how we treat her nice like hello and thanks from her and us she even remember us the date so there is voice recorded date in the record

ARE WE ABLE TO FIGHT HER AND HER LAWYER WITH THE RECORDING.??

oh and in the voice we agree with 90 days guarantee
 
You are welcome to do anything you want on your private property. Some states have laws about audio recordings where one side doesn't know they are being recorded, but usually in most of those states it only applies to private settings. Your business is open to the public. They would probably fight you on the admittance of the device especially if you don't record every day. They would say that it was doctored. You really do need a lawyer and they can tell you your specific state laws on it. You will need someone who knows the law to fight them on it and you can try and counter sue for defamation of character and sue for lawyer fees. 25,000 sounds like a lot of money since the car is probably not worth that much.
 
Yes, you can use the tape to corroborate anything you can testify to.

That is, if it recorded her saying something when you weren't around, it might not be admissible. But if you made the recording, and you were there while it was recording, it would be admissible in court, because it's nothing more than a record of what you're giving testimony to.
