In California, how can I legally use a demand draft to recover a debt owed

to by business by another business? Put simple, my company placed an order, paid by bank wire transfer, then the supplier did not deliver. The supplier refuses to handle the problem but my business is enrolled in a an echeck (demand draft) service and I have all the necessary information to create a demand draft against the company that is refusing to return my company's payments. I don't want to break any laws, is there a legal way to do this such as simply giving them advanced notice that we will be issuing a demand draft against their account?
