I'm a server, is it legal for the restaurant i work for to make me tip out the busser?

I've been with the company almost ten years. they are changing their policy. we usually tip the bussers based on what we make in tips (10%), now they will be deducting a base amount according to our sales. i'm concerned because some of these bussers don't do anything, they walk around on their cell phones all night and we bus our own tables most of the time. i just need to know if this is legal in virginia...
