there a limit on how much the wife gets? Guy has job & has assets ~$1MM. Girl is poor but has job. They marry & have kids. Guy misses his freedom and starts spending less time at home & finally can't take the nagging anymore and files for divorce. There is no pre-nup and guy admits that he married for the wrong reasons & he no longer has feelings for wife. Wife still has feelings & wants marriage to stay together. Since this is guy's fault, does the wife come out a $winner?
 
Most states are "No fault" states, which means it doesn't matter how the marriage dissolved they are both held accountable equally. So no, she does not always come out the winner as you call it. But she will come out with half!
 
It depends how long you've been married and what state you live in. California, for example, is a common law state.
