if my xbox 360 ARCADE doesn't work, do I still get credit for it?

I think the Eye of the 360 is a bit wacked out, and appearently reading on XBOX.com sending the damn thing in would cost $100 just to get the peice of crap back. So, if I send it in and say that I suspect the eye is wacked, Will I still get credit for the system? Or will they rip me off, and tell me to go shove it in a box and send it anyways?
Edit: So, if they give me a new one with no game save status (I still have my Hard drive. ;D what will they charge me for it?
