If I get a jail broke iphone do I still have to pay the monthly data fee?

I want an Iphone but really dont want to pay the data fee. Ive seen a few iphones on ebay that are jail broken. Plus I have a phone with a contract that ends in november I dont want to pay a cancelation fee either can I just put the sim card from that phone into the iphone or whatever new phone I get? I know it sounds like I'm cheap but I'm going into college and want to save the money
 
do you already have an AT&T account? you're very vague abt that. if so, i'm sure the phone would work but you would not be able to use any data based services if you don't have a data plan (email, internet, tv,etc). if you don't have AT&T then only the cell service will work and nothing else.
