If I don't buy my new phone from Verizon can I avoid the data plan?

So I'm up for a new phone and don't want an outdated feature phone but I also don't want to get a smartphone (because that means Verizon will require a $30 data package). If I buy a phone off ebay, that would normally require a data plan if I bought it from Verizon, can I avoid paying for the data plan?
