if i called apple would i be in trouble if they found out i jail broke my ipod?

i jailbroke my ipod and now theres an error. but im afraid that if i call and they ask me if i modded it the they might charge me.
is jail breaking illegal and will i be fined if they find out?

It's not illegal. You just voided your warranty. I think it's a bad idea. If you bring it back to the Apple Store and they can't fix it, you can't get a free replacement. You'll just have to pay for another iPod.

You can do whatever you want with your property. You own it. If you want to take it apart, hack the software, or poke around with it, it's perfectly fine to do so.

However, doing so voids your warranty, so Apple is no longer under any obligation whatsoever to fix it or even provide tech support.
