if i buy an android phone do i need to change my contract?

i currently have tmobile as a cell phone provider and i want to buy the htc my touch from a friend and im not sure that if i buy it im going to have to change my contract or add a data plan or if the phone is going to work as soon as i insert the sim card. can any one help. thanks
