If I buy a phone for verizon that is no longer sold at the store, do I have to pay

for the data package? I am trying to buy this phone called the Samsung Reality. It used to be sold by Verizon but it is no longer. When it was being sold it required a $9.99 data package for activation. Now that it is not being sold by them, does it still require the data package? I don't want to have to pay it obviously.
