If employers access your *hidden & private* Facebook and discipline you, isn't

that a violation of privacy? I've been seeing more an more articles lately over people getting fired or not getting jobs over what their employers may see on facebook. My question is, if you set your settings so only friends can see your profile and have no connections to your work, employers cant see it right? And if they do get around that setting and see lets say, bad comments about them on facebook, wouldn't it be illegal for them to use it against you because they acquired it by illegal means (violating your privacy)? You can sue them right back!
