I had just passed the stop sign (fully breaked and then after checking the road both sides passed the road) and while i was passing the road i got hit by a bike (bicycle). I totally did not see him as he had no lights at all on the bike and was wearing dark clothes (it was night). He jumped on my car with his bike and rolled over to the side of the street. He was not injured at all (just a minor scratch on his knee). The cop told me quote, "you are not getting a citation or anything. He was at fault as he had no lights on his bike at night, and he is getting a ticket for it. You're good to do. You don't have to report to insurance company if he does not" I live in PA. Because he had no lights on his bike I was not at fault. It was determined that his bike hit my car instead of me hitting him. Now what do I do? Do i call my insurance company? Will my rates go up even though I was not at fault? My car was bumped on the hood a little bit from his body/bike hitting it. Any responses are greatly appreciated on what I should do. He said he would not report it to the insurance, but that's just his word...do I take his word for this? Thank you. There were witnesses to the place of the accident and they told the police all that happened.
