I placed a deposit on a car and now he wont give it back! is it fair?

Unless you signed a statement surrendering your deposit you are entitled to get your money back. If he had "Missed sales" and he did not get their names in case you backed out that is his fault,no penalty to you at all for his piss poor management of the sale process.
 
I found a car on craigslist and went to see it. A few things were a little off but i placed a deposit on it to think about it and to see if given time the guy would fix the problems with the car. I went over the very next day after telling him not to proceed with any smog check or anything and told him i had changed my mind. he went on on how he lost customers and he had dont the smog so he wasnt giving it back. i wanted to see if i have the right to get i back or not.

A deposit is to hold something..Since he didn't put any money into it I believe legally he has to return it..Did you get a receipt of the deposit? If not then its your word against his..
