I keep hearing about 'prey drive' in dogs, and how this excuses a lot of behaviors?

Cats also have prey drive, granted, it is more pronounced. Heaven help mice in my house! Do you think it is OK for a dog to kill a cat because of their 'prey drive' instinct? I am asking, because a few years ago, a Jack Russell terrier, came into my yard, and ripped a kitten apart in front of my kids. The kitten was in a basket on the verandah. The owner of the dog said it couldn't be helped. The dog acted 'instinctively'. Does 'prey drive' make it OK to kill other people's pets? Should owners of these dogs with known 'prey drives' be made accountable for their behavior?
The Police slapped a dangerous dog label on the JRT, and the owner was surprised, 'It's only a cat' . Have others come across this sort of attitude before?
