I HIT THE CAR AND FELL OFF, OR I SLIDE OFF THE BIKE SLID UNDER THE CAR AND I SLID?

while i was riding the other day, some asshole in the car infront of me, decided he would stop in the middle of the lane at around 40 miles per hour by slamming on his brakes to pick up a passenger as he was a cab, that caused me to either choose to bail from the bike in which i braked and tried to move into the next lane but it was occupied by another vehicle so i basically slide off the motorcycle and it went under the car, and i slide to the side of the car, now everyone seen that this guy stopped illegally during a green light while traffic was flowing in the middle of the lane, now my insurance is saying if i say i hit the back of the car then im at fault as thats how predetermined fault works in ny, but if i say from what people who witnessed the accident say, if i say i slide off the bike and the bike went under the car, then it could possibly be taken a different way, and the driver would be held responsible for how he stopped as i didn't actually hit him, im just saying what do you guys think, i have to pick which way to go with this.

So i need some advice as i have comprehensive coverage only and not collision so my insurance isn't going to help me out so i either have to open a lawsuit or go after his insurance, plus i heard of some no fault law where i get compensated or some stuff any insight to that? thanks
