I hit someones car, he gave me two estimates, and he wants to fix it at the highest...

...estimate? I ws backing up and barely hit him, leaving a small scratch by his back wheel and scratched his rim. He got two estimates for me, one for 1200, and another for 900.... I told him I will pay the shop $900 whenever he wants to get his car fixed but he insists I give him the cash to fix it later on, and he wants to fix it at the shop that costs $1200.

Why should I pay an extra $300 if he gave me two estimates? So I figured this guy just wants the money, do I have the right to pick which estimate I want and pay the auto shop whenever he wants to fix his car?
I talked with my insurance company and she said its better to settle it without the insurance because I would have to pay an extra $800 for 3 years

Exactly Nikky, he just wants the money in his pocket which is pissing me off.... Do you know if I have the right to choose whether I pay him or the autoshop?
 
Yeah Get written estimate sheet from the repair shop and i dont know what kind of insurance you have but you may pay that much over a three year span but that is really high. i would let the insurance handle it b/c it seems like this guy just wants to scam you

Legally you only have to pay the lower estimate, and I dont blame you for wanting to pay the auto shop.

If he gives you a hard time about, the best thing to do would be to tell him to take it to court.

In court they would make you the pay the lower estimate to him.

But if you both have insurance they should take care of all of this.

Why isnt the insurance companies handling this?


Edit: That makes sense. Well in that case I would try to talk to him and tell him that you are willing to pay the lower one directly to the auto shop, and write it up in a contract and both of you sign it, thats the best way to do it so you dont get screwed over in the deal.
And if he is not willing to settle on that then tell him to take it to court, he'd be stupid for not wanting to just settle on the lower one though, and hes stupid for showing you both estimates.


Yeah it sounds like he just wants money dont let him screw you over.
As for paying him or the auto shop, I dont think it matters, I know in court you would just pay him.
if you do end up paying him just make sure all your paying for is what damage you caused. And once you pay its done and over with, which is why you HAVE To have a contract, cuz if you give him that money and he decides later on that it wasnt enough and wants to sue you for more money, if you have that contract saying thats what you settled on that he cant get you anymore, its done and over with



I tell ya what you should do is tell him that you want to pay the auto shop and if he says no, then just tell him then he can take it to court, and most likely he will go ahead and just let you do that, he most likely wont want to deal with court and all of those costs
 
tell him you want proof of the estimates. the person who takes the estimates for the repairs could give a theoretical reciept, and then he can bring it too you. in that case, write up a small contract that you both sign saying that you will pay the estimate at so and so's business directly. This way no cash goes into his hands, he gets his car fixed. and your done with the whole issue.
