I have a felony case pending in court for a cell phone which I plan to take a plea

1 day in jail and reduced? the charges to a misdemeanor. Could this hurt my custody case I have with my 77 year old mother who wants custodyof my two kids 12 and 9. Might I add who has had a stroke with pending memory problems and can't drive.
 
It certainly doesn't HELP your case. But if that's your ONLY issue, you should have no problem. It's very uncommon to see a mother lose custody to a grandmother, who normally has no legal standing.
 
Your mother is suing for custody of your kids? That's messed up.

Yeah, it certainly won't help that you are going to be a convicted felon. But I doubt that alone would be enough to make you lose the case. But there must be more you aren't saying because 77-year-old grandmothers don't just randomly do that kind of thing. Talk to your lawyer about both whether to take the deal and what it would do to your custody case.
