Yeah, in Indiana, if you fail ANY kind of drug or alcohol test, Child Protective Services will take the baby and the mother would go to jail for child abuse.

Yes, they definitely can. In Georgia, possessing weed is actually a misdemeanor and failing a drug test is a felony.
