How to get id-theft-related info from a business that refuses?

I was the victim of identity theft. Someone used my name, e-mail, phone number, and address to get a new credit card, and purchase something. I was not personally charged anything, but it was under my name. I have done everything I have been advised of so far (credit agency fraud alert, contacted the FTC, went to the police).

The company that the purchase was made at, Nutrisystem, refuses to give me any information regarding the person posing as me, citing their "privacy policy." According to documents I've received from the credit agencies, the Fair Credit Reporting Act gives me "the right to obtain documents relating to fraudulent transactions...using [my] personal information" from either creditors or businesses.

Is there anything I can do to get this information from Nutrisystem? If they delete all this information from their system before I even get a chance to obtain it, is there anything further I should consider? I'm guessing I have the losing hand here...
