Hello, I live in the state of California. I was in a toxic relationship and my ex and I were seeking help from a couples counselor. The counselor showed big favoritism towards my ex and even helped her devise plans to falsely paint abuse allegations against me. The cops were involved and they were very suspicious so they didn't buy it and told me to file a report against the Board. I also have an admission from my ex that everything was planned falsely. In the mean time my ex is still seeing this counselor (my ex's job gives her free and unlimited visits to see this couples counselor who is now her individual counselor) and the counselor is giving her advice on how to win in family court (she accidently sent me a voicemail telling my ex what exactly to do to look like a victim). I was verbally harassed by the counselor and even mocked to the point where she basically said "go ahead and try, there is no way you will be able to prove it anything unethical."
I filed the complaint with the board and recently I was called by them and they told me that they see enough evidence for a investigation BUT my ex is refusing to sign the authorization to allow the investigation! I have no clue what to do but during a free consultation with a lawyer, the lawyer told me that its very likely the counselor is telling my ex not the sign the authorization in order to cover up her unethical practices. It seems my ex's counselor knew how to cover up her and my ex's harassment towards me.
Is it possible for me to mail her an official request allowing the investigation? If she refuses (again), can I bring it up in family court? My ex is using her "HIPPA rights" to cover up the harassment that her and her counselor put me though. Could I convince the family court judge to override my ex's refusal?
