How should my car accident be dealt with? When it is not my fault?

On March 25th my mother and I were involved in an accident. She picked me up from school and we were taking the freeway to a local market. Suddenly when we were exiting we heard tires screeching as if someone was trying to stop and we thought it wasn't near us, then all of a sudden our car gets struck by a toyota tacoma. It was the first time myself or my mother got into an accident, and didn't know we had to call police, we thought we had to call police for injuries. So we pulled over and exchanged information, and I took pictures of the accident. Two days later we receive a call from the party that hit us and he says "I have a friend that works at a body shop and he'll look at the damage and tell us if I'm guilty or if you're guilty." But the other party stated that night "I was trying to make the exit and I almost missed it, so i tried to merge in as fast as I could but was going too fast and didn't have enough time to stop and i hit you, i'm guilty." Also the day we got a call from him telling us we should meet we already took the car to the body shop that was appointed by our insurance agent. NOW I spoke with the adjuster and told him that there were no injuries and gave my recorded statement. Although my mother was the driver, I am under the policy and have right to give the statement. The adjuster told me that in the computer it states that the other party's adjuster has not yet received a statement and is hard to get in contact. Why must we pay $1000 out of our pocket for which is not our fault to pay for the damages that the other party created? My uncle said to just go ahead and claim injury, but how can we claim injury, 6 days have passed, the night of the accident I came home and wrote down everything that happened, to everything the other party said. And we put down that we were not injured. It would sound like we are lying if we suddenly hire an attorney and claim injury when we stated we were not injured...How do you guys think we should deal with the $1000 deductible? I was gonna have my parents call up our agent and since my parents have been with this agent since 1985, and we wanted to see if maybe the body shop could hold our car and the deductible statement until this situation is resolved. Is that the only best choice?
