How often is it that Apple will replace your ipod with a brand new one?

I bought my Ipod Touch second-hand off ebay. It was already registered. It is still under its one year warranty. Can I go to the apple store and say something is wrong with it and get a new one? Or will they just ship it off to get service then ship it back?

Also , since it was already registered (not by me) will that stop them from servicing me? will they think I stole it?
