I have very little proof. But I do have some proof. Some of which is circumstantial. But the defendent has no proof whatsoever.
I know that innocence until proven guilty. I am the accuser and I need to prove guilt. Its not her responsiblity to prove her innocence.
Anyway. How undeniably rigorous of proof do I need to win a civil lawsuit for no more than $300.
I mean, for example, adultery is a felony in most states... but accusations of adultery are sufficient grounds for divorce, but wont hold up as a felony charge.
The defendent in my case is not risking prison time... only a few hundred bucks which I can pretty clearly illustrate that she owes. I can prove beyond any doubt that she had at one time owed me money... but I cannot disprove her claims that she already paid me in cash - which she didnt do, but she has already told me that she will tell that lie in front of the judge.
Thank you Marcia. But like I was asking, what is required to constitute proof of debt?
I have bills from companies for the household on whole - no specific names - just a date... a date I can prove that me and her were both residents. We were to split the bills equally among us.
I can also acquire bank statements that prove that payment of these bills came out of my pocket.
Thirdly, I have a piece of paper written in her handwriting which clearly states that she owes me money - and according to the notation she used, also indicates that she has yet to pay.
